PLEASE CAREFULLY READ OUR TERMS & CONDITIONS BEFORE SIGNING UP FOR ANY OF OUR SERVICES AT SEQUOIA.

At Sequoia Movement we offer aerial, floor and strength based classes, personal training and small group classes, workshops, specialist courses, massage therapy and venue hiredesigned for those wanting to explore and discover what their bodies are capable of.

Your use of our website and purchasing of any of our services either on this site or at one of our studios will be subject to these terms & conditions which are subject to change at the discretion of Sequoia Movement Ltd.

We use the online booking app – TeamUp to store clients information, book classes and send out information regarding your membership with us.

To sign up to one of our classes and be able to book – please ensure you have filled out our ‘sign up form’ and completed our Physical Activity Readiness Questionnaire (PAR-Q).

By providing us with your information and attending our sessions you agree to allow Sequoia Movement to process your information for this purpose and understand you will be contacted with regards to our upcoming classes and other business related causes from time to time.

TERMINOLOGY

Sequoia or Sequoia Movement means Sequoia Movement Ltd.

Company number: 11892502

Sequoia Contract means the Rules, the Membership Terms and the Enrolment for Memberships or Services.

We, Us, Our, Company means Sequoia Movement Ltd.

You, Your, Yourself, I, means the person who is specified as the member in Your Enrolment for Membership.

Parties means You and Us.

Studio means a Sequoia Movement Ltd place of business or operation.

Goods and / or Services means the goods and / or services and / or facilities provided by Sequoia Movement Ltd to You.

Students, Members, Clients means the person receiving the service.

Terms & Conditions – SECTION ONE:

1.0 INTRODUCTION

These are the terms in which Sequoia Movement Ltd is willing to provide service to You at Our studio.

Such services include but are not limited to: Personal Training, Group Training Sessions, Nutrition Advice, Workshops, Massage Treatment, Courses, Venue Hire.

2.0 INVOLVED PARTIES

The service terms are between Sequoia Movement Ltd and You and You acknowledge and agree that You are over the age of 18 years of age.

3.0 OUR RULES OF SERVICE

3.1 You must ensure that You read, understand, and abide by the rules of Sequoia Movement Ltd which are notified to You through this document, signage, handouts, or are located on Our website. www.sequoiamovement.com

3.2 Our Rules govern Your use of Our Studio. In becoming a service holder or taking part in a Sequoia run session, You agree to abide by Our Rules which are binding and apply to all users, members, guests and visitors of Our Studio. You are also responsible for Your guests and visitors whilst they are using Our Studio.

3.3 If You break any of the Rules, We will respond in a way which we consider fair and reasonable which may include the following:

3.3.1. A written warning; or 3.3.2. Suspension or cancellation of Your membership or service.

3.4 If Your breach causes us or another person costs, losses and / or damages, You agree to pay for these.

4.0 UNDER 18 YEARS OLD

4.1 Should there be a circumstances whereby You are under 18 years old, a parent or guardian must sign all documents required by Sequoia Movement Ltd and must accompany You at the Studio.

4.2 We reserve the right to refuse You access to the Studio if You are under the age of 18 and attend the Studio without Your parent or guardian present.

4.3 We reserve the right to request proof of age from any applicant for registration.

4.4 For further information on under 18 year old attendance and use of our studio. Please refer to our Safeguarding Policy available upon request from training@sequoiamovement.com.

5.0 OUR AGREEMENT

When You sign our service terms, You are entering into a legally binding contract with Us. It is important that You have read and understood all the terms and conditions of the Sequoia Movement Ltd Contract before signing our Terms and Conditions.

If the service Terms and / or the Sequoia Movement Ltd Contract differ from anything You are told at the Studio or over the phone, the Terms and / or the Sequoia Movement Contract will apply, unless written confirmation is received from an employee of Sequoia Movement Ltd.

Terms & Conditions – SECTION TWO:

6.0 RISK OF INJURY & SERIOUS HARM

You acknowledge that participation in physical activities, particularly aerial training and other high-intensity/exercise classes involves risks, including but not limited to the risk of serious injury or death. By signing this agreement, you voluntarily assume all risks agreeing to accept full responsibility for any injuries sustained as a result of your participation waiving the right to hold Sequoia Movement Ltd liable for any injuries, except in cases of gross negligence or wilful misconduct.

7.0 RISK & RESPONSIBILITY

7.1 Sequoia Movement Ltd will take all reasonable steps to ensure the safety of participants but cannot accept liability for injuries caused by the inherent risks associated with physical activity unless due to negligence on our part.

7.2 You take full responsibility for informing the instructor at hand and ensuring all information held on Sequoia Movement’s online system that may affect me during class is up to date in account of any personal details, physical or mental impediments Youhave prior to attending Sequoia Movement. Youtake full responsibility for Your actions and will ensure You conduct Yourself in a manner deemed to be safe and appropriate by Sequoia Movement at all times.

7.3 It is Your responsibility to inform Sequoia Movement by emailing ahead of Your appointment / class or booking at training@sequoiamovement.com if any of the above answers are YES and if You feel there are any reasons not mentioned above why any type of physical activity may not be suitable for me.

8.0 INFORMED CONSENT

8.1 By attending Sequoia Movement and participating within sessions, You confirm that you are fit and healthy to do so. You understand that it is Your responsibility to consult with a medical professional before starting any fitness programme to ensure your suitability to perform physical movement.

8.2 By booking a class at Sequoia Movement You confirm that You have read and understood this form in its entirety and that You are aware that Sequoia Movements full Terms and Conditions can be found on their website at www.sequoiamovement.com along with their privacy policy our safeguarding policy is available upon request.

8.3 You understand that as with any exercise, participation comes with risk of injury and physical harm and You acknowledge the risks involved in physical activity and agree to participate voluntarily, following the guidance of instructors at all times.

9.0 DESCRIPTION OF RISKS

The purpose of Sequoias voluntary exercise programme, personal training and our group fitness classes are to help you improve cardiovascular fitness, muscular strength and endurance, flexibility and to learn new skills and movement patterns.

Whilst for most people exercise is hugely positive with many health benefits, there remains some risk that we require you to be aware of.

The following describes some of the risks of exercise programmes the use of its infrastructures and working at height:

a. Slips, trips, falls or painful crashes while using the facilities or equipment, landing mats, floors below, aerial equipment and bathroom facilities.

b. Injuries resulting from falling, including, but not limited to, falling onto persons, falling and coming into contact with any walls, structures or ropes, or falling to the floor.

c. Muscle strains or sprains. Injuries related to improper use of

d. Over exertion, dizziness, fainting, dehydration, pre-existing medical conditions could be worsened or exacerbated.

You acknowledge that the risks described are examples and that other risks, including unforeseen events, may arise.

10.0 ACKNOWLEDGEMENT OF RISKS

You acknowledge that:

10.1. The activities that form part of Sequoias classes and personal training involve the risk of physical harm and You may be injured while performing the activities.

10.2. You may cause injury to other people while performing these activities.

10.3. You have disclosed all pre-existing medical or other conditions that may affect Your ability to engage in the activities.

10.4. You understand that should any information change with regards to Your health, fitness or contact details that You need to notify Your instructor / Sequoia immediately.

10.5. You confirm that the information You have provided is, to the best of Your knowledge, accurate and complete.

10.6. You acknowledge that instructors provide guidance based on their expertise, but it remains Your responsibility to consult a medical professional regarding my fitness to participate.

11.0 GENERAL LIMITATIONS

To the fullest extent permitted by law, Sequoia Movement Ltd, its owners, directors, employees, agents, and representatives (hereinafter referred to as “the Company”) shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Studio, participation in classes, and utilisation of services, including but not limited to injuries, losses, or damages in any form resulting from:

11.1 Your participation in any physical activities, including but not limited to aerial training, strength training, flexibility training, floor-based training, personal training, group classes, or any other services offered at the Studio;

11.2 Accidents, slips, trips, falls, or other incidents occurring on or about the Studio premises;

11.3 Equipment malfunction or failure, including that of aerial rigging, apparatus, and other fitness equipment provided by the Company;

11.4 Actions or omissions of instructors, staff, or other participants in classes or events;

11.5 Medical conditions exacerbated by participation in activities or services provided by the Company.

11.3 INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Company from any claims, actions, damages, liabilities, costs, or expenses (including legal fees) arising out of or relating to your use or misuse of the Studio, participation in any classes, or any breach of these Terms & Conditions.

11.4 MEDICAL DISCLAIMERS

The Company is not responsible for any injuries sustained as a result of pre-existing medical conditions. You confirm that you have disclosed any relevant medical history or conditions to instructors prior to participating in any activity and that you have sought proper medical guidance if necessary.

11.5 EXCLUSION OF LIABILITY FOR NON-DISCLOSURE

If you fail to provide accurate, complete, or updated information regarding your medical condition, health status, or any other relevant details that could affect your participation in activities, the Company shall not be liable for any injury or damage resulting from such non-disclosure.

11.6 LIMITATION ON DAMAGES

In the event that the Company is found liable for any damage arising out of your use of the Studio or participation in activities, you agree that the Company’s liability shall not exceed the amount you have paid for the relevant services within the preceding six (6) months.

11.7 FORCE MAJEURE

The Company shall not be liable for any failure to perform its obligations under this clause if such failure results from events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, or governmental actions.

12.0 YOUR CONDUCT

12.1 The use of Vulgar language, abuse of equipment or staff or any other inappropriate behaviour will not be tolerated and may result in suspension or cancellation of Your membership, with a cancellation fee.

12.1.1 You have the right to appeal a cancellation or suspension decision by contacting Sequoia Movement Ltd within 7 days of notification. Please email: training@sequoiamovement.com and we will provide written feedback within 10 days of receipt.

12.2 You may be held liable for damage caused by wilful misconduct or gross negligence.

12.3 You agree to follow all reasonable direction of an employee and / or contractor of Sequoia Movement Ltd relating to health, safety or security or related matters.

13.0 YOUR RESPONSIBILITIES

13.1 You will notify the instructor before the session begins if you have sustained any injuries, illnesses or medical conditions and/or if you feel there are any parts of the session you are unable to take part in.

13.2 Participation in any activity at Sequoia Movement is completely voluntary.

13.3 Please ask as many questions as possible during the session, especially if you do not completely understand any move that is demonstrated to you.

13.4 Exercise and physical activity carries with it an element of risk and you may experience some possible bruising, discomfort during and after and feel slightly achy for a few days after exercise due to delayed onset muscle soreness (DOMS).

Each session has been designed to minimise those risks and with continued practice your body will become conditioned to the movements involved, however if during the session you feel excessive pain or discomfort, You will notify the instructor immediately.

13.5 Participation and attendance to Sequoia Movement is not permitted when under the influence of alcohol or illegal drugs. No smoking is permitted inside the studio or anywhere else on the studios property.

Terms & Conditions – SECTION THREE:

14.0 ENROLMENT FOR SERVICE

14.1 If You are a new client You are required to fill out a consent form and PAR-Q (Physical Activity Readiness Questionnaire) before going to Your first class. We require the listed information in order to complete Your Sequoia Movement profile and ask important medical information about Your state of health.

14.2 All clients must be over 18 years of age to participate in our classes unless explicitly stated that a class is intended for under 18 years of age. For further information on under 18s participation, Please see 8.0.

14.3 By signing the consent form, You are confirming that You have read and agree with our full Terms & Conditions.

14.4 Submission of an enrolment for service is an offer by Sequoia Movement Ltd to You to become a paying user. Sequoia Movement Ltd reserves the right to reject any Enrolment for service at its sole discretion.

14.5 All memberships and services are Non-Transferable & Non-Refundable. Services are valid for the duration of time stated at time of booking.

14.6 All Services are subject to the terms of the Sequoia Movement Ltd Contract and as amended by Sequoia Movement from time to time.

15.0 OUR SERVICES: PERSONAL TRAINING, PRIVATE SESSIONS, MASSAGE TREATMENTS

15.1 All personal training sessions and massage appointments are to be pre-booked through training@sequoiamovement.com and paid by You in advance.

15.2 Any cancellations must be made twenty-four (24) hours prior to the scheduled appointment time and notification provided directly to Your appointment lead in writing via SMS or email. You are responsible for ensuring the appointment lead receives adequate notification. Should you not have details for your appointment contact please email training@sequoiamovement.com.

15.3 Failure by You to provide adequate notice within the 24hour window may result in forfeiting the session (unless otherwise agreed with Your contact in writing) and Sequoia Movement Ltd is under no obligation to refund or perform these personal training sessions.

15.3 In the case where adequate notice is provided a make-up session must be arranged within the same monthly cycle otherwise Your session is forfeited (unless otherwise agreed in writing by Sequoia Movement). If You fail to complete sessions within the monthly cycle, Sequoia Movement Ltd is not obliged to refund or credit sessions.

15.4 Should You fail to show up for Your scheduled session, You will lose it and Sequoia Movement Ltd is under no obligation to refund or perform these sessions.

16.0 OUR SERVICES: CLASSES, GROUP TRAINING, WORKSHOPS & COURSES

16.1 All sessions are subject to availability.

16.2 All bookings for group training are to be made online, via the Sequoia Movement TeamUp Booking App, website, email, or over the phone to the studio or one of our instructors.

16.3 You are required to confirm your name and attendance to the instructor upon entry to the session.

16.4 Should You not be booked into a session, You are not guaranteed a position within the session and Sequoia Movement reserves the right to refuse entry. This is for the safety of the other members in the session.

16.5 All sessions must be paid for in advance or Cash payment provided to the instructor of the session You are required to notify Sequoia Movement a minimum of three hours prior to class should You need to cancel. Failure to do so may result in You losing Your session credit or being charged an automatic penalty fee of £2.

16.6 A purchase of a session or a package does not guarantee access to a particular session. Sessions are filled on a “first come first served” basis, and if a particular session is full or otherwise not available the cost of that class will be held to the credit of the client to be applied to another class to be selected by the client (subject to availability).

16.7 Sessions operate with a waiting list. If a session is full, You can choose to join the waiting list. If a space becomes available, You will be notified by email of its availability – You will then have the opportunity to join the session. Should you miss the time frame of 30 minutes given for answering this email your space may be given to the next individual on the waiting list.

17.0 MASSAGE TREATMENTS AT SEQUOIA MOVEMENT

17.1 SERVICES PROVIDED

Sequoia Movement Ltd offers a variety of massage treatments designed to promote relaxation, relieve tension, and enhance overall well-being. Massage services may include but are not limited to Swedish massage, deep tissue massage, sports massage, and therapeutic modalities. Specific services and their duration will be outlined upon enquire at training@sequoiamovement.com.

17.2 CLIENT RESPONSIBILITIES

Prior to receiving a massage treatment, you agree to disclose any relevant medical history, conditions, or concerns to your massage therapist. This includes, but is not limited to, any allergies, recent surgeries, chronic pain conditions, skin conditions, or medications that may affect your treatment.

17.3 CONSENT AND CANCELLATION

You will be required to sign a consent form prior to your first treatment, acknowledging that you understand the nature of the massage services and that you consent to receive treatment. If you wish to cancel or reschedule your appointment, please provide at least 24 hours’ notice. Failure to do so may result in a cancellation fee equal to that of the treatment cost.

17.4 LIMITATIONS OF LIABILITY

While our massage therapists are trained professionals, receiving massage treatments still carries inherent risks. You agree that Sequoia Movement Ltd, its massage therapists, and any other staff members shall not be liable for any injuries, discomfort, or reactions that may arise from your massage treatment, including but not limited to:

17.4.1 Adverse reactions to oils, lotions, or other products used during the treatment.

17.4.2 Worsening of pre-existing conditions or injuries.

17.4.3 Physical discomfort or soreness post-treatment.

17.5 HEALTH AND SAFETY PROTOCOLS

The Company is committed to providing a safe and hygienic environment for all treatments. All massage therapists will adhere to strict hygiene protocols, including regular hand washing and sanitisation of equipment. If you feel unwell or believe you may have a communicable illness, please reschedule your appointment for the safety of our therapists and other clients.

17.6 PREGNANCY AND MEDICAL CONDITIONS

If you are pregnant, breastfeeding, or have any specific medical conditions, please inform the massage therapist prior to your appointment, as certain techniques may not be suitable. All massage treatments will be tailored to meet your individual needs, taking your health circumstances into consideration.

17.7 PRIVACY AND CONFIDENTIALITY

Your privacy is important to us. All treatment records and personal information will be kept confidential in accordance with our privacy policy. No information will be disclosed to third parties without your consent unless required by law.

17.8 TREATMENT EFFECTIVENESS

You acknowledge that the effectiveness of massage treatments can vary among individuals, and no specific results or outcomes are guaranteed. It is recommended to maintain an open line of communication with your therapist throughout the treatment process to ensure comfort and satisfaction.

Terms & Conditions – SECTION FOUR:

18.0 CONTRACT COMMENCEMENT

Your Membership / Service will commence on the Start Date as set out in Your Enrolment for Membership or on the date of purchase.

19.0 STUDIO ACCESS AND GROUP TRAINING

You become a member of Sequoia Movement Ltd under the type of membership / service paid for via our website, booking system or studio. Your use of the Goods and / or Services of Sequoia Movement Ltd are governed by the Membership or type of booking. Sequoia Movement Ltd reserves the right to introduce, withdraw and / or vary categories of membership by providing You with thirty (30) days written notice.

20.0 LATE ARRIVALS

20.1 It is requested that clients arrive at least 5 minutes prior to the start of classes. If You are not in the studio for the start of a class, Your place may be given away to another client.

20.2 Due to the nature of our classes and for Your own safety should You arrive more than 10 minutes late for a 60min+ class, the instructor has the right to exclude You from the class.

20.3 We do not allow latecomers to 30 minute classes and we hold the right to deny entry to the class if You do not arrive ready to start at the correct time. This policy is to help prevent injury as well as to be considerate of the teacher and other clients who are already participating in the class. In certain exceptional circumstances we may allow for discretion of this rule.

20.4 If You turn up late for a class and are not admitted, the cancellation policy will be applied and it will be classed as a no show.

Terms & Conditions – SECTION FIVE:

21.0 PAYMENTS

21.1 You are personally responsible for payment to Us of the membership or session fees as and when they fall due.

21.2 Your membership fees are payable in advance in accordance with the Membership Type or service selected in Your Enrolment or booking.

21.3 Sequoia Movement Ltd reserves the right to use the services of a third-party billing company to deduct membership fee payments.

21.4 If the direct debit option is taken, Your membership fees will be direct debited from Your nominated bank account or credit card. By nominating a credit or debit account, You authorise Us to deduct from that account all fees and other charges You are responsible for under the Membership Terms.

21.5 It is Your responsibility to ensure that You have sufficient funds in Your nominated bank account when the fortnightly payments are to be direct debited. If there is insufficient funds in Your nominated bank account, or there is another reason that Your account was unable to be debited, You will be responsible for any administration fees and or collection fees charged by Sequoia Movement Ltd and / or any third-party billing providers.

21.6 In the event that You fall into arrears in respect of any membership fees payable, all arrears must be paid by You in full before You can use the Studio. Sequoia Movement Ltd or its payment system provider will notify you in writing 5 days in advance before exercising the right to deduct arrears due from Your nominated bank account or credit card provided to Us.

21.7 Omitted term.

21.8 If Your membership fees are overdue, Sequoia Movement Ltd reserves the right to terminate Your membership at any time; refuse entry until full payment has been made to either third-party party debt collection agency or Sequoia Movement Ltd.

21.9 Sequoia Movement Ltd is not liable for any fees incurred by You from Your designated bank or card provider for any late fees or charges incurred for failing to meet direct debit agreement with Us.

21.10 If You seek to terminate the Sequoia Movement Ltd Contract or stop the automatic debit arrangement in a manner not prescribed in the Membership Terms, then You may be liable to Sequoia Movement Ltd for damages for breach of contract.

21.11 You must tell Us if You are transferring or closing Your account or card, at least 7 days before Your next direct debit. You must also tell Us about any changes to Your account or credit card, such as an expiry date or number, at least 7 days before Your next direct debit.

21.12 Sequoia Movement Ltd reviews membership fees periodically and may change the membership fees from time to time. Your membership fees may be increased at the discretion of and at any time by Sequoia Movement Ltd, subject to sixty (60) days written notice.

21.13 Sequoia Movement Ltd will notify You in writing. It is Your responsibility to ensure that Sequoia Movement has up to date contact information for You. Where we have made a reasonable effort to let You know about a membership fee increase, You authorise Us to increase any direct debits from Your nominated bank account or credit card.

21.14 All membership fees include all government taxes and rates. We reserve the right to change Your membership fees in line with any government tax and rate changes.

22.0 PAYG CLASS PASSES AND MULTIPLE PURCHASES

22.1 Our FITNESS Classes and AERIAL classes are priced differently, therefore:

22.2 By purchasing a FITNESS Class pass You are entitled to book onto any Exercise Class within our FITNESS Class timetable. FITNESS Classes exclude those of Aerial Tissue (Silks), Aerial Lyra, Aerial Trapeze, Aerial Hammock and Aerial Corde Lisse.

22.3 By purchasing an AERIALS or SKILLS Class pass You are entitled to book onto any AERIALS Class within our AERIALS Class timetable. AERIAL Classes include those of Aerial Tissue (Silks), Aerial Lyra, Aerial Trapeze, Hammock and Aerial Corde Lisse.

23.4 MONTHLY DIRECT DEBIT MEMBERSHIPS

23.4.1 Our monthly memberships require a 3 month minimum sign up period, this starts from the date of your first direct debit payment.

23.4.2 You are not permitted to cancel within this time.

23.4.3 Should you wish to cancel your membership during our minimum contract period, you will be charged a cancellation fee amounting to the price difference between our Pay as You Go monthly memberships and our discounted direct debit membership. This charge amount will be applied for each month used up to the date of cancellation.

24.0 PAUSING MEMBERSHIP

24.1. Pauses can not be applied during the initial 3 month minimum membership period, nor can they be applied to our Pay As You Go membership options unless agreed priorvia Sequoia management team or for medical reasons with reasonable proof (ie. Doctors note).

24.2. We require a minimum notice period of 5 working days with requests being sent in writing to training@sequoiamovement.com.

24.3. We can apply pauses to memberships for a minimum of 4 weeks and a maximum of 12 weeks.

24.4. Once the pause has terminated your membership will automatically reinstate and any direct debits due will be charged.

24.5. We can only apply 1 pause to a membership during any 12 month period.

24.6. Should you need to make more than one pause within a 12 month period we will honour special circumstances surrounding illness, injury or pregnancy – please note – we may require evidence of this in the form of a doctor’s note with clause 24.3 still applying.

24.7. In all other circumstances students will need to cancel their membership providing 1 months written notice to training@sequoiamovement.com and then reinstate their membership via our booking system when required.

25.0 CANCELLATION OF MEMBERSHIP

25.1 All cancellation requests for all Membership Types require thirty (30) days written notice by You to Sequoia Movement Ltd.

25.2 Cancellation requests must be provided via email to training@sequoiamovement.com.

25.3 Cancellation requests provided via phone call, fax, SMS, social media or other medium may not be accepted.

25.4 All cancellation requests may be received by Us at any time. However, Sequoia Movement Ltd reserves the right to deny requests when the conditions of this clause have not been met by You.

26.0 CANCELLATION OF CLASSES

26.1 You can change or cancel any bookings, up to 3 hours before the start time of the class You have booked without penalty.

26.2 Late cancellations and No shows – Any bookings cancelled within 3 hours of the class starting will be deemed as a late cancellation and will incur a charge. The same applies for no-shows. The charge is outlined at the time of booking and sits at a minimum of £2.00. Those who book in with a single class pass or are a class bundle holder will lose their class session should You late cancel or No Show.

26.3 Charges are applied automatically via the goteamup account and payments will be taken from the acrd associated with the account.

26.4 If a class is cancelled by Sequoia Movement Ltd for any reason, we will make every effort to contact You via our goteamup notification system, email, message or telephone to let You know. Clients that have their classes cancelled; pay as You go or bundle holders will have the session refunded on to their account within 5-7 working days.

27.0 REFUNDS

27.1 All purchases are final.

27.2 All memberships and services are Non-Transferable & Non Refundable.

20.3 Sequoia Movement does not offer refunds on services or products for change of mind, user error, injury, illness, change of address or any other reason.

27.4 Passes and memberships are non-transferable. Passes and memberships can not be shared.

20.5 Refunds or credits may be considered at our discretion for documented cases of long-term illness. A doctors note stating you are unable to participate in physical exercise for 6 months or more may be required.

28.0 TERMINATION OF MEMBERSHIP BY SEQUOIA MOVEMENT LTD

28.1 We may terminate Your membership immediately by emailing or writing to You at the contact addresses We have on Our records:

28.2 If You commit a serious or repeated breach of Your Sequoia Movement Ltd Contract;

28.3 If any part of Your membership fees remains unpaid 28 days after falling due;

28.4 If You provide us with details which You know to be false when submitted Your Enrolment for Membership Form and these false details may have affected Our reasonable decision to grant You membership; or service

28.5 Sequoia Movement Ltd is of the reasonable opinion that You are in violation of acceptable conduct.

28.6 You put the health, safety or well-being of Yourself, Sequoia Movement staff or other members of Sequoia Movement Ltd or the public at risk; or

28.7 You purposely damage Our equipment.

Terms & Conditions – SECTION SIX:

29.0 STUDIO FACILITIES

Sequoia Movement Ltd reserves the right to vary staffed hours, classes and / or to temporarily close certain areas of any Studio or timetable from time to time without notice for the purpose of cleaning, decorating, repairs, renovations or for special functions, events and holidays.

30.0 INTERNET ACCESS AND SOCIAL MEDIA

30.1 You are personally responsible for all content that You publish online, whether in a blog, social network or social computing site or any other form of user-generated media.

30.2 If a member of staff, independent contractor or another member harasses You, please make Us and the appropriate authorities aware immediately.

30.3 Any breach or unsocial behaviour on machines or inciting hateful, racial or defamatory behaviour or materials, You may be asked to leave the Studio and Your membership may be terminated by Sequoia Movement Ltd at any time without notice. Examples include: Offensive or discriminatory comments, Breach of confidentiality, Defamation of Sequoia Movement Ltd or its members.

31.0 PHOTOGRAPHY

31.1 Sequoia Movement and its instructors may take photos and/or film during classes. This footage may then be used for marketing and social media purposes as well as the production of online materials.

31.2 Opt-Out. Should you wish for photographs to not be taken and used of your image please ensure you notify the instructor / person involved at the time.

31.3 Should you wish to Opt-Out of all photographs during sessions please email: training@sequoiamovement.com so that we can make a note on your Goteamup profile making instructors fully aware at the time of your booking.

31.4 Sequoia Movement intends to take and use photography and/or film footage within sessions so to advertise and market classes and the organisation.

32.0 PERSONAL BELONGINGS

32.1 All personal belongings brought into Sequoia Movement Ltd studios are at the clients own risk, the company does not accept any liability for loss or damages to such itemsexcept where caused by our negligence. Sequoia Movement Ltd accepts no responsibility for any property left on the premises.

32.2 All items found will be put into lost property and will be taken to a charity shop on the last day of every month. Any jewellery or keys found will be kept for a longer period of time. If You think You have left something behind, please notify us ASAP via email to training@sequoiamovement.com.

33.0 YOUR PERSONAL INFORMATION

33.1 You accept full responsibility for updating Your personal information to Sequoia Movement Ltd for the purposes of billing, marketing and / or contact information.

33.2 You are responsible for advising Sequoia Movement Ltd of changes to Your personal information. Where Sequoia Movement Ltd is required to provide any written notification,

33.3 Sequoia Movement Ltd will send the notice to the email or home address on the Enrolment for Membership or any updated address You have provided to Us since joining.

33.4 Any notice sent by Sequoia Movement Ltd in accordance with this clause will be deemed received by You three business days from the date of dispatch.

33.5 We comply with the UK GDPR and the Data Protection Act 2018 in protecting personal information. Please review our Privacy Policy on our website for further details. Our website www.sequoiamovement.com. The Privacy Policy explains the ways which we collect, use, store, protect and disclose Your personal information.

Terms & Conditions – SECTION SEVEN:

34.0 HEALTH, SAFETY AND INJURIES

34.1 You are aware of the possible health and safety risks associated with participating in physical activity and consent to any reasonable exercise which may from time to time be strenuous.

34.2 You acknowledge and agree that exercising and using the Services of Sequoia Movement Ltd may involve risk of injury and You exercise and use the Studio at Your own risk.

34.3 You have made Sequoia Movement Ltd aware of any relevant medical conditions or health problems and if necessary have obtained clearance from a registered medical practitioner to participate in physical exercise. You are aware that if Your medical conditions change, You will need to sign and complete a medical new form and You take sole responsibility for doing so.

34.4 You will ensure that the information disclosed to Us will be true and accurate and not misleading in any way. You will not attend and use the Goods and / or Services provided by Sequoia Movement Ltd whilst You are suffering from illness, disease, injury or any other condition that could present a risk to the health and / or safety of other members, guests and / or employees of Sequoia Movement Ltd or Yourself.

34.5 Our employees and / or contractors are not medically trained. We reserve the right to refuse entry and / or terminate Your membership if, based on reasonable evidence, such as staff observations or failure to provide a medical clearance note, You do not satisfy the medical and / or physical conditions required to participate in any activities of Sequoia Movement Ltd and You do not provide Us with medical clearance to prove otherwise.

34.6 You recognise that Sequoia Movement Ltd personal trainers and / or instructors are not able to provide You with medical advice regarding medical fitness and that this information is issued as a guidance to the limitations of Your exercise ability.

34.7 You must not conduct Yourself in a manner which will cause harm or discomfort to Yourself and / or other members. You must notify any employees and / or contractors of Sequoia Movement Ltd of any injuries and / or changes in Your health which may impact Your ability to continue Your exercise program or use the Goods and / or Services provided by Sequoia Movement Ltd.

34.9 All clients are requested to wear a form of dress that is appropriate for the session they are attending. Please ensure You bring Your own water to keep hydrated. Wear sunscreen during sunny conditions. Should you be participating in aerials, please ensure you do not wear any items of clothing such as zips, watches, rings, bracelets and jewellery that may catch and damage our fabric equipment. Long sleeves and Leggings are also recommended.

34.10 Trainers must be worn in all Small Group Training classes to avoid the risk of injury. Exceptions to this will be to classes conducted within our movement studio on our soft matting & Yoga matts. If You forget Your trainers, Your participation in the class is at your own risk and the instructor is within their rights to refuse your participation should they feel necessary.

35.0 EMERGENCY MEDICAL CONSENT

35.1 Consent to Treatment: You hereby authorise Sequoia Movement Ltd, its employees, contractors, and representatives to administer first aid and/or arrange for emergency medical treatment in the event of an accident, injury, or illness occurring while you are participating in activities within our facilities and / or under our supervision.

35.2. Authorisation to Seek Medical Assistance:

You authorise Sequoia Movement Ltd to contact emergency medical services (e.g., ambulance, paramedics) if deemed necessary and to act in your best interest until professional medical assistance is available.

35.3 Medical Information Disclosure:

You confirm that all medical information provided on your Physical Activity Readiness Questionnaire (PAR-Q) is accurate, and you agree to notify Sequoia Movement Ltd of any changes to your health that may affect your participation in activities.

35.4 No Liability for Assistance

You understand and agree that Sequoia Movement Ltd and its employees, contractors, and representatives are not liable for any claims, damages, or losses resulting from the provision or delay of emergency medical care, except in cases of gross negligence or willful misconduct.

35.5. Parental/Guardian Consent

If the participant is under 18 years of age they are considered a minor, in this case consent must be signed by a parent or legal guardian, granting permission for the minor to receive emercency medical care.

36.0 EMERGENCY PROCEDURES

36.1 CONTACT INFORMATION

You are required to provide up-to-date emergency contact information upon signing up for services at Sequoia Movement Ltd. This information will be used in the event of an emergency.

36.2 EMERGENCY PROCEDURES DURING CLASSES & APPOINTMENTS

In the event of an emergency during classes, such as a medical emergency, fire, or other critical incidents, the following procedures will be implemented:

36.2.1 INSTRUCTORS RESPONSIBILITIES

All instructors are trained in basic first aid and emergency response procedures. Where possible Instructors will assess the situation and take appropriate action, including calling emergency services if necessary.

36.2.2 PARTICIPANT RESPONSIBILITIES

If you are alerted to a medical emergency or potentially threatening situation, notify the instructor immediately. If you feel unwell or injured, seek advice from the instructor.

36.2.3 EVACUATION PLAN

In the case of a fire alarm or other evacuation signal, all participants must follow the marked emergency exit routes and listen to the instructor’s guidance.

36.3 EMERGENCY EQUIPMENT

The studio is equipped with a first aid kit located within the Movement Room Cupboard as you enter the room (Signed with a First Aid Notice). These kits are accessible during all classes, and instructors are trained to use the equipment therein.

36.4 REPORTING INCIDENTS

All incidents, including injuries, must be reported to the instructor immediately. A report will be documented, which may include details about the incident and any first aid given. Copies of this report will be kept on file.

36.5 COMMUNICATION OF EMERGENCY PROCEDURES 

Information about emergency exits, first aid kit locations, and procedures will be displayed prominently within the studio. You are encouraged to familiarise yourself with this information and ask staff about any uncertainties regarding emergency procedures.

36.6 COMPLIANCE
Adherence to these emergency procedures is mandatory. Failure to comply during an emergency situation may jeopardize your safety and the safety of others.

37.0 SECURITY & PHOTOGRAPHY

37.1 The Studio is under 24-hour camera surveillance therefore Your activities within our facility are recorded. The video is used for security purposes. CCTV is for deterrence and evidence purposes and cannot guarantee complete security.

Terms & Conditions – SECTION EIGHT:

38.0 CONTRACTORS

38.1 Sequoia Movement Ltd reserves the right to use independent contractors to provide goods and / or services at our studio.

38.2 There may be other services, including personal training services, offered at the Studio by Us, contractors, licensees and others which are offered separately and / or in addition to services provided under the Membership Terms.

38.3 We are not responsible for these third-party services including fees or any associated costs, claims or refunds, unless they are provided by us.

38.4 We will take reasonable care in selecting and monitoring contractors, but we are not responsible for their actions or omissions except where required by law.

39.0 CHANGES TO MEMBERSHIP, CLASS & SUDIO TERMS

39.1 To ensure continued applicability and relevance to our operations Sequoia Movement Ltd may amend the Membership, Class and Studio Terms at any time, changes to written policies above minor grammatical and spelling edits will be notified to all current members via your goteamup account.

39.2 Any changes will be effective from the date of notification.

39.2 Changes will be applied to all versions appearing on our website, goteamup booking Plateform and in studio.

39.3 Terms and Conditions are shown to each customer at signup on our goteamup booking app before interacting with our customer site. Existing customers will be shown a message alerting them to the new policies.

39.4 Should you not agree with our revised terms You will have the option to opt out of further participation at Sequoia Movement and terminate your contract within 14 days of the update notification being sent.

40.0 COMPLAINTS AND FEEDBACK

If You have any concerns about the Goods and / or Services provided by Sequoia Movement Ltd or anything else in relation to Your membership, You should raise it with management of Sequoia Movement Ltd by emailing training@sequoiamovement.com.

41.0 OTHER TERMS

41.1 Force Majeure – Memberships may be suspended during periods where services cannot be provided for reasons beyond our control and caused by extraordinary circumstance. Examples of natural and political events and situations that may full under this category are: Earthquakes, Fires, Floods, Pandemics, War, Strike, Riot, Crime, Government Enforced Lockdowns.

41.2 The failure by Us to enforce any of Our rights at any time for any period shall not be construed as a waiver of these rights. Any failure to identify or act upon a breach of Your Sequoia Movement Contract shall not be deemed to be an affirmation by Sequoia Movement Ltd that Your behaviour is acceptable.

41.5 If any part of this agreement is found to be invalid or unenforceable by a court, the remainder of the agreement shall continue to be valid and enforceable to the fullest extent permitted by law.

41.6 Nothing in this agreement shall limit or exclude our liability for death or personal injury caused by negligence or fraudulent misrepresentation.

42.0 CAR PARKING FACILITIES

42.1 Car Parking facilities are provided for users of Sequoia Movement only and may only be used when You are using the facility. Sequoia Movement accepts no liability for any loss or damage which may result from Your use of the car parking facility – All such use is at your own risk.

42.2 Membership or payment for a session does not guarentee the availability of a parking space. Parking spaces are available on a first-come first-served basis.

44.0 LAW AND JURISDICTION

These terms and conditions (including any non-contractual matters and obligations arising therefrom or associated therewith) shall be governed by, and construed in accordance with, the laws of England and Wales. Any dispute, controversy, proceedings or claim between the Parties relating to these Terms and Conditions (including any non-contractual matters and obligations arising therefrom or associated therewith) shall fall within the jurisdiction of the courts of England and Wales.
